Arbitration will follow the American Arbitration Association’s Consumer Arbitration Rules unless otherwise agreed in writing. Each party will bear its own legal and expert costs, though Clearlink will cover administrative fees for claims under $75,000 unless deemed frivolous. This clause does not prevent you from filing complaints with federal, state, or local agencies. If any part of this section is found unenforceable, the remaining terms will remain valid.

16. Mobile Marketing Terms

Disputes under these Mobile Marketing Terms are subject to the arbitration clause and class action waiver in Section 15.

  • 16.1 Subscribing to Marketing Texts and Calls: You may opt in to receive marketing texts and calls by providing express written consent.
  • 16.2 Consent Details: By opting in, you agree to receive automated promotional and personalized messages. Consent is not a condition for purchase, and standard messaging rates may apply.
  • 16.3 Message Frequency: Message frequency may vary, and Clearlink may alter it or change the originating number with notice.
  • 16.4 Number Changes: Notify Clearlink if your phone number changes to avoid unauthorized messages.
  • 16.5 Revoking Consent: To stop receiving messages, text “STOP” to the designated number. This action does not opt you out of other communication methods.
